On December 11, 2008 Caylee’s remains were discovered in a swampy area near her home. Up to that moment, the little girl had been missing for six months and investigators had been looking for her for five months.
At the time, Casey was in jail in Orlando and already indicted in her daughter’s death.
Anthony was brought to the waiting room of the jail’s medical unit by investigators so they could capture her reaction to television news coverage of the remains’ discovery.
The video is black-and-white and grainy. It does not contain audio and it is difficult to detect any facial reactions. As law enforcement officials stand nearby, Anthony can be seen breathing heavily at one point, doubling over with her hands in her lap and sometimes appearing to wipe her tears.
Orlando TV station WKMG argued in court for the release of the footage, insisting that it was a public record. Since 2009, the clip had been under judicial seal by a judge who ruled that its contents were inflammatory and could affect her ability to receive a fair trial.
Anthony’s attorney, Jose Baez, tried to keep the footage from being released, claiming that because the clip was taken while his client was in a medical facility, releasing it would violate medical privacy laws.
On Friday, Orange County Superior Court Chief Judge Belvin Perry Jr. dismissed Baez’s claims and decided there was no reason to keep the footage sealed.
“The reason for sealing [the video] – Ms. Anthony’s right to a fair trial – is no longer applicable because the trial has been completed and she has been acquitted of all charges other than lying to law enforcement officers,” Perry wrote in his decision.
“There is no reasonable expectation of privacy in jail. The fact that she was sitting in a waiting area of the medical facility did not convert the incident into a medical evaluation and the fact that medical personnel had the opportunity to observe her while she watched the news coverage and gave her a sedative does not change this conclusion.”
