According to TMZ, the Canadian filed a paternity petition on December 30, 2010, after formally acknowledging the child.

Sources told the site that Gabriel Aubry wants to protect his rights especially now that he is separated from Halle Berry.

However, sources close to the two, cited by TMZ, say Berry and Aubry have worked out whatever differences they had.

They have not filed for custody, visitation rights or child support, and do not intend to do so.
