After the Betty Ford employee who accused Lindsay of assault claimed she refused to take the breathalyzer test, the troubled star risks spending 6 months behind bars.

RadarOnline.com reported that Lohan eventually took an alcohol test, which she passed, the morning after the incident.

According to a source cited by RadarOnline, “Judge Fox made it very clear to Lindsay: a dirty test, or a refusal to submit to a test, would be counted and considered as a dirty test.”

“Lindsay is in very, very big trouble. It’s very likely Judge Fox will haul her into court in the next week to deal with this,” the source continued. “Judge Fox had been willing to give her a second chance.”

However, as the documents were confidential, Holland and TMZ could face violation of HIPAA laws and be subjected to criminal prosecution.
