The actor won’t be criminally prosecuted for assaulting the driver of a party bus in Cleveland last month.

“After a review of the facts, [officials] came to the conclusion not to charge,” a spokesperson for the local Cleveland Prosecutor’s Office told TMZ.

The alleged incident occurred in Cleveland on August 28.

Fox allegedly tried to board the “party bus” driven by Heather Bormann. She claims the actor was intoxicated and that he became violent when he was denied access.

Bormann is accusing him of assault, battery and infliction of emotional distress, according to the court documents.

She is seeking more than $ 25,000 in damages.
